  • Need help regarding H1B visa stamping

    Hi,

For couple of months I was working with organization A, in the meantime my H1B visa for organization B is also approved. I decided to take PTO with org A and join org B. After a week of work with org B, I submitted my resignation for org A. However org A convinced me to continue my job with them, hence I decided to keep my job with org A and now planning to leave or resign from B. My problem is I am planning soon to visit india where I will need to get my visa stamped as it is expired. My question is would this switching of job from A to B and back to B would cause any issue while visa stamping? Based on this issue would immigration officer reject my visa?

    Please advice me on this.
    Thanks

You cannot work for two employers unless you have a concurrent petition.

Were you working for B without getting any transfer receipt/approval? Did you get paid from both A and B for that week?

This is my opinion not legal advice.

      Hi,

I have approval notice for both the employers. I did not get paid from employer A and will get paid for employer B. Please let me know your view.

      Thanks

So you will have to file a H1 transfer from B to A again.

This is my opinion not legal advice.
