H1B stamping in Mumbai, I-140 approved from previous employer, currently 3 yr ext

  • H1B stamping in Mumbai, I-140 approved from previous employer, currently 3 yr ext

    Hello,
    I have my 1-140 approved by my previous employer and got a 3 yr extension for my current employer (i have utilized my 6 yr period). My current employer has not started my Green Card process, and my I797 is valid till Jan 2016. I have the following questions:

    - Are their chances of my visa being rejected or a 221g when I go for stamping this Dec, based on the fact that though I have my I797 till Jan 2016, my current employer has not started my Green Card process?
    - Are the chances of getting my H1B stamped in Canada higher than getting it stamped in Mumbai? Any pros and cons?
    - What is the latest date by which my current employer needs to start my GC processing based on the Jan 2016 I 797 validity date?

    :Monali , dont worry. they can reject h1b based on this provided fact .

    - Are the chances of getting my H1B stamped in Canada higher than getting it stamped in Mumbai? Any pros and cons?

    : its always advised to do stamping in Mumbai than Canada.

    - What is the latest date by which my current employer needs to start my GC processing based on the Jan 2016 I 797 validity date?

    : usually GC process can take one to one n half year so you should start accordingly.
