  • H1B Transfer and revoke questions

    Hi All,

    I got the H1B CAP on 2012 and Visa was stamped for 1 year only and validity has been expired on Company A.( Valid from 01/10/2012 to 30/09/2013) for 1 year as per I-797B form.

    But i didn't travel to US using the H1B . Now i have changed the company and working on company B.

    But during the CompanyA final exit process original I-797B form was returned, also i have checked in the online on my receipt number it was revoked ( https://egov.uscis.gov/cris/Dashboard/CaseStatus.do) bu Company A.

    I am having the I-797B copy and receipt number.

    my Question:

    1. whether i can able to transfer this H1B after revoke or any way to use this H1B ?
    2. if yes, will able to go for re-stamping with only photocopy of I-797B.
    2. Having the copy of receipt number/I-797B form
    3. My H1B receipt number was revoke in the online .
    4. I never use this H1B to travel US.

    Could you please help to clarify this question.

    2. if yes, will able to go for re-stamping with only photocopy of I-797B. -New company will file for transfer & provide you new petition with which you can go for stamping
    2. Having the copy of receipt number/I-797B form -The company B will need it for checking purpose only
    3. My H1B receipt number was revoke in the online . -No issues

      Resume in interview

      Is it possible to embassy to access my resume, I've sent it to USCIS for applying H1B visa? Do they check and match my resume which I will bring it for interview day to the first sent resume?

        Thanks for reply.

        So i am in CAP exempt. During petition of new H1B, i can provide them the copy of my previous H1B approval so that i can get CAP exempt and file the petition right for my existing H1B CAP?

        not required for new H1B CAP . So i will process any time ?

          Company which will sponsor will need only the first page of I797,it can filed at any time
