  • H1b to F2 – Change of Status

    I am presently on H1b, the first 3 years expiring in 1.5 months. My company is in the process of applying for the extension. My husband is on F1, already graduated with STEM degree, working on the 17 month STEM extension EAD-OPT at an e-verified organization. About 12 months are left on his EAD-OPT. We are expecting our first child soon and I am looking to take a break from my work and stay at home. Here are my questions –
    1) Is it possible for me to change my status from H1b to F2? I know husband’s school will issue a new I-20, but will they also ask him to show enough fund now to fulfill education now that he has already graduated and working full time.
    2) If I have to convert my status to F2, does it need to happen before my initial h1b expires? Or is it possible to have my employer send necessary documentation to USCIS for H1b extension and after 2 months (before my h1b extension is approved by USCIS) I can change my status to F2. During that time will I be considered out of status as USCIS has not approved my H1b extension?
    3) If I change my status to F2, is it possible to go on that H1b a later point in time if I wish to pursue employment after some years? How difficult/easy is that?
    4) Is there anything else that I need to know that might jeopardize my immigration status?
