  • Mulitple visa application after layoff

    Hi all,

My case is little strange. I am on H1-B and work for a research group assume it "A" in a university since funding didn't get renewed I got laid off(currently in notice period till the end of this month aug 2014). I managed to find another job in the same university assume it "B" and they filed the amended H1-b petition and request for extension, I will got the receipt also. I also managed to find another better job in different organization (non-profit) assume it organization " C "and they are also willing to file H1-B for me. so my questions are:

    1. Can I file another H1-b transfer request with "C" ,given one is already in process with "B" ?

    2. I do want to join organization C , so do I have to wait for my H1-B approved by group B before I file another H1 with " C "? or can I file using H1-b petition from "A" , please also note I will go out of status starting next month if i didnt join any where(I was also told that I can work for group "B" as soon as I get my H1-B receipt), also I will get paid and will have pay stub from A for this month.

Please do let me know, any help and suggestion will be appreciated.

    Thanks,

    Thanks,
Since there is less than a week remaining, I would suggest you join B, and only after getting approval and few paystubs of B apply for C. Though C can apply a petition for you but it will be a bridge petition, thereby the transfer to C would be subject to approval of transfer to B and things can go complicated making you out of status and then even though probably C 's petition gets approved it may require you to leave US and re enter, if visa valid, otherwise need to go for visa stamping.

This is my opinion not legal advice.

Thank you very much for the reply,

      I have one more query.

I do have I-94 valid till the end of this year from the employer A, do I still will need to leave the country and enter again if C 's petition get approved ( or if they go for premium processing, whereas B's petition is in normal processing)

      Thanks,
