  • Did not file the i-129f in k3 case , and got approval notice of i-130

I am from Pakistan and My wife who is by birth American has applied I130 Form for her spouse on 24th march 2014 and she received I 797 Form on 1st September 2014 with “ approval notice, Section Husband or Wife of US citizen, 201(b)INA” . and the case is send to NVC. As my wife thought that after receiving approval notice of I 797 form than we do file i-129F, therefore, she did not submit I-129F form. Now we know that we can only file I 129F before the approval notice of I 797. Would you please guide me, whether we can file now after having received approved I797 Form or not. Further, what should we do now for further proceeding. I feel totally hopeless, please guide me what should we do now.

Forget about the K3 and filing a K3 I-129F. K3 visas are no longer actively supported by USCIS, and once your I-130 paperwork reaches the National Visa Center, a K3 I-129F would be denied or ignored.

Thanks you Ray B for your information.

Do i need to apply for the k3 all over again?
What should I do now ?
Whether I.129F is mandatory, and without filing it all process of I.130 of K3 is wasted .
What do you suggest me me to do now.

I dont think you understand what I posted below. THERE IS NO K3 VISA ANYMORE. YOU'RE WASTING YOUR TIME SUBMITTING AN I-129F FOR A K3 APPLICATION. YOUR I-130 IS WHAT WILL GET YOU A SPOUSAL VISA. The I-130 you submitted is for a spousal CR1 or IR1 visa.
