  • Passport Expiring - Going for Visa Stamping

    Hi Experts,

Need your guidance on the following matter

Scenario: I Just switched jobs in the US. I am on H-1B (beyond 6 years after I-140 approval) and wife is on H-4. Kid is American citizen. My passport expires in April, 2015 but I have I-797 A which goes through till 2017. me and my wife are planning India trip in Mid October. Both of us will need to get the Visa stamping done in India. Now my visa appointment will be less than six months away from my passport expiry. I have following questions

    1) Will my visa get stamped or there is a requirement that passport should be at least eligible for six months at the time of stamping or (I have also heard) till the time I-797 is approved (2017 in my case)?
    2) If my visa gets stamped ok, then I am sure to get a truncated I-94 when I return to the US. Correct?
    3) I will renew my passport once I return but then how will my I-94 be extended?

    Please let me know
    Vijay
