  • Leave the country permanently after second DUI

    I recently had second DUI. I had been planning on leaving USA for good and give up my Green Card. Will they come chasing me in my country and arrest me there for not completing the DUI court proceedings and probation.

    Or is it just that I will have problem re-entering the U.S.

    Dude ,

    Do not run away like a coward. I have got 2 as well in a span of 2 years and got moved to a deferred prosecution program where if you complete treatment and accept you are an alcoholic - you will be let go just one time so long as you complete the requirements.

    Moreover it is not about running away. This is the age of technology. Your record will be available globally for any officer to check even in the remotest town of Africa. Stay strong and fight it head up and on.

      You seem quick - eager almost - to give up your American dream.

      You have a green card! Think of how precious that is.

      Why avoid the requirements of your probation? It is meant to be rehabilitative, and you will benefit from completing any diversionary programs.

      Certainly, stop drinking and driving, but it doesn't mean you have to be miserable. Consider moving somewhere with excellent public transportation, to mitigate the risk of getting caught violating the law again.

      Havent you seen the hobos on the beach in southern California? America is the greatest place on earth to be a drunk.

      You mention being worried about reentry. How do you expect to ever come back after giving up your green card?

        In which state did you have your DUI?

        Were there aggravating situations like child in the car, hit someone or major property damage?

        DONT Run away.

          Samsmith - I don't know any particulars about your case. Whether it is felony, misdemeanor etc...
          But one thing for sure is, Don't run away. Face it.
          One good thing i have seen in this country is you make a mistake, you correct it and prove that you are a good citizen, you will still get your chances.
          2nd DUI is not good. It means, you have not learnt from the mistake. But running away will just put a stamp on you saying (what ever,,, i cant name it).
          My honest advise, face it. Complete the responsibility you have. You will have mental peace at-least.
          Every countries immigration forms has this Q? Have you been arrested? Lying is like taking chances again.
          I was told the same thing from my friends, RUN away. But i didn't. I faced it and I'm lot relieved now.

            Hi SeaHawks,

            How are you, you mentioned you have 2 DUI, i am in the same situation with 2 DUI's in 2 years. i want to go to india for H1 B visa stamping for the first time with 2 DUI's, any idea of me getting visa or no. Did you go to H1B stamping with 2 DUI's and please share the experiences.
