Hi friend,

I'm for calcutta India and has been selected this year H1B lottery.

I'm waiting for H1B stamping and my petetion is approved.I'm having receipt no and I797C.

Under this circumstances I want to initiate H4 dependent visa.

can you pls clarify the questions regarding this.

i) My spouse is non working and having valid passport.Can she apply for h4?

ii) Can she apply H4 before my H1B stamping?/During stamping of H1B I need to take her to consulate for initiating H4 processing?

iii) I'm having receipt no and I797C.Is it enough to initiate H4?

You will have to wait for the petition to be approved. Then both of you can apply for your respective Visas at the consulate.

So I'm planning to fillup online DS - 160 first for H4 dependent along with uploading scanned coloured photograph of my spouse.Then I'll submit that online and later while H1B stamping will be held we will go together with the confirmation pages of online submitted DS 160s and other supporting docs.Kindly confirm whether my understanding is correct.

Both of you can fill-up your DS-160's now, but then again it is better to wait until you get the approval. Filling the form takes 1 hour max. There's no point in just filling the form right now.

Thanks for your suggestion.Actually as per my employer the approval for H1B is already done(waiting for stamping in probably Oct 2015).But no docs like approved I-129 / I797 is shared yet(But I797C is there with the receipt no).So Kindly let me know is it the right time to raise a request to employer to get those docs for proceeding further for H4 application/ visa stamping?

If your H1B petition is already approved, then you can go for stamping anytime. You can ask your employer to provide you all the required documents for stamping. Attending the visa interview earlier is advisable so that if by chance your case goes into admin processing, you still have time to provide the required documents to try and get the visa approved before Oct 1st.

They don't let you create two accounts with the same email address and first & last name combination. Maybe you already have an account, just try the forgot password option with your email id. or you can try with a different email address. This is because the email address is counted as the username for future login.
