Hi all, here is my situation. I got Visa to the USA through my wife who is a US citizen. The visa will expire in five months. The thing is I am no more interested in living with my US wife and i don't want to move there as i have a great job where i live. We couldn't agree on who should move and we have decided to separate (divorce). The thing is I neither of us want to cause problems for the other. So if she files for change of status will this be considered as a sham marriage? since i didn't go to the USA and let my Visa expire? what are the consequences for her?
