I have a question that i am seeking some answers on.
My EB1C based I-140 application was filed and received a priority date within Dec 2015. My current status is on L1A. I have been checking the processing time status on USCIS pages and as per my calculations the I-140 is expected around end of April.
My law firm suggested that we wait for I485 filing post the approval of the I140 because the bar with EB1C is high and it's better to wait. Since the law firm was being paid by my employer I didn't argue too much and let it be, despite knowing that I485 could have been filed concurrently. Since the application was based on EB1C, the labor certification was not required.
My circumstances are changing though. I do not want to work for this employer too long. The employer doesn't know of course and they are still sponsoring my process. My questions
1) If my I140 gets approved end of April, and the I485 has not yet been filed - what exactly is my status ? Consider i am currently on L1A.
2) Can a new employer take my I140 approval over and then file for I485 under their employment without having to go through H1B, labor certification etc. ?
3) Once I485 gets filed how long does it take to get EAD which i believe frees me up ? Or do i still need to wait 6 months post I485 filing before i can change employers?
Please advise on best course of action even if i haven't asked the right question above.
