  • H1B Transfer and H4 Renewed with old employer

Me & my Wife had a US Visa from 12 Dec 2014 to 30 Sep 2015 and we both have applied for an extension of H1B and H4 Visa in my previous organization(employer A) & my wife went to India on Nov 04, 2015 for some personal work. Later we both got the extension approved from Nov 19,2015 to Feb 20,2018(as per I797-A receipt).

Now for moving to new employer B, I got the change of employer petition approved with the new date from 12/09/2015 to 12/01/2018 only for me and I haven't done anything for my wife. Also I have got the Visa stamping few days back(Mar, 2016).

Now my wife is planning to come back to USA along with my new born baby. So please let me know how the Visa process has to be initiated for my wife and kid. Please explain in detail.

Technically your spouse and child are eligible for H4 visas. You can also use drop box facility for them. You would need to fill out the online DS-160 and submit the relevant paperwork at a US consulate office.

This is my opinion not legal advice.
