    Hi All

    I got h1b through company A and visa got stamped and has valid for 3yrs, But I didn't travel to US. I got an opportunity with US based Company B, who is ready to transfer H1B on their name , its a small company in US.

    But I have below questions;

    1) Company B suggested me to go for stamping again, So what is the success rate to get visa stamped again? even If I have valid visa stamp on passport already?
    2) what kind of questions may arise during Visa interview?
    3) If I fail in VISA interview, will USICS return H1B transfer fee to Company B?

    Please provide your valid inputs.

    1. Visa approvals do not go by probability, the chances significantly improve with a genuine employer having capability to show suitable work for your skill set, and pay you as per law.
    2. Employer specific and job related. Check the experience section.
    3. No fee will be refunded. Why you worrying about it? Its the employer who has to pay that cost.

      221g/cap exempt

      Hello Raghvi- I was given 221g on 7th October 2015 when I appeared for h1b visa interview from new employer.

      Since it was taking lot of time, I applied under cap exempt from my current employer in Feb 2016. The petition has been approved and I am waiting for hard copy of the approved petition and stamping.

      Question is today I received an email from embassy stating that you need to submit your passport for final processing of administrative processing.

      I want to process the visa with my current employer and not with the new employer under which I received 221g.

      Please suggest:
      1. What happens if I don't submit my passport for the pending 221g case.
      2. If I go for the visa interview from the current employer will I be asked as why I did not pursue through the new employer.
      3. Now that administrative processing has been processed and they have requested for submission of passport; will I need to mention "yes" in DS160 for visa denials.


      Please help. Looking forward for any suggestions.

        1) is it mandatory to for stamping again? or do we have any drop box facility to get my pp stamped again?

          my petition is approved with Employer B, But I have a valid Visa with Employer A.

          Can I use Employer A visa + Employer B petition to travel to USA or

          Should I go for re-stamping with new employer B petition?

            It's not mandatory but it is advisable. Also, in most likelihood one gets I94 to match the visa/I797, whichever is earlier.

              Drop box

              Hi All

              I have a valid visa and Petition from Employer A, but I never travel to US.

              Now my petition is transfered to Employer B.

              If I want to go for re-stamping,

              Am I eligible for DROPBOX option or I have to book appointment with Consulate and get stamp done again.

              Kindly advice.
