  • K-1 visa with arrest record

I haven't started the K-1 process yet because my fiance plans to come visit me, and he's applying for a B-2 visa. I wanted to wait until he got here before I started the K-1 process because I'm worried he could have problems getting a B-2 visa if when a K-1 petition has been filed for him. Plus, he isn't disclosing that he knows anyone here. He is coming here just as a tourist, but we'll spend time together. If he says he's visiting his fiance, I'm sure he'll be denied a B-2 visa right away.

The problem I'm worried about is the interview process for the K-1 visa. My fiance was arrested 4 years ago because he was participating in a peaceful protest against Vladimir Putin. He was almost immediately released, but I'm worried now this will show up on his police clearance, and I know that having any kind of criminal record can make it very difficult to be approved to come to the US. I don't know what the best plan is now. Would it be better for me to go to Russia and marry him, then apply for him to come as my spouse? I know that process is longer.

Does anyone have any experience similar to this one? Thanks!
