Hi,
I worked 3 years on L1B. After 3 years, I switched to H1b and now its been 3 months on H1b. Both times I was shows as resource in organization chart (not lead or manager). Overall I have 17 years of experience in my field, with 6 years with same employer.
Now my company agreed to file GC for me, but going in GC process with H1 is extremely long. My H1b petition is expiring in June 2017.
- Can I convince my manager to file L1A, while I stay in US ?
- I can wait for 1 year before filing Green Card and my manager can show me as lead and people reporting to me. Will that be sufficient ?
- Can USCIS deny L1A, saying that same person was recognized as skilled labor in previous visa, how come he become manager now./
- I read "Generally have been working for a qualifying organization abroad for one continuous year within the three years immediately preceding his or her admission to the United States". Is it mandatory or there is alternate, which can fulfill this requirement ?
