H4 to H1, not able to get ssn

  • H4 to H1, not able to get ssn

    Hi,
    I tried to search but couldn't find answer or situation discussed. Please suggest or help me find answer.
    I am currently on H4 visa. I have a valid H1B visa which was approved very late, in late OCT 2015. I travelled India in early NOV 2015 and entered back on MAR 2016 on H4 as I didn't want to go visa stamping. My approved i797 has different i94 number than I see online.
    Now if I go to ssn office and give them my i797 and respective i94, they say you are still on h4 and they are not able to validate against USCIS system. What should I do, please suggest.

        So I just stopped working, I want to start only when everything is clear.
        How can I fix this, any suggestions?

          Well you are not in H1 status hence you are not eligible for SSN. You entered on H4 visa so your status is H4. Your employer needs to file a Cap exempt petition as COS in order for you to convert from H4 to H1. You can work and be eligible only after it is approved.
