  • Green Card Holder Failed To File Income Tax While Outside US

A very good day to everyone.

I am in the Philippines right now. My father died last December prompting me to go home to attend his funeral and burial. I have been here in my country for almost six months. The reason for my prolonged stay is that my father has a saving account in a bank and we can not withdraw his money (the money that I send them while I am working in the US) unless we give them the necessary documents needed to access it. In my country, completing all those documents really takes a lot of time.

My problem is, while I am away, I failed to file an Income Tax Return. I just learned that failing to do so will truly hurt my Permanent Resident status.

Please help me so that I can still get back to the US. I diligently pay my mortgage there and also maintain two bank accounts plus some credit cards, if that helps.

Your quick response will be very much appreciated.

    Thank you!

    Ron,

You're imagining a problem that doesn't exist. A delay in filing your U.S. income tax return will not jeopardize your Green Card status or reentry to the U.S. Whoever told you otherwise is smoking the wrong kind of cigarettes.

On the other hand, when you apply for Naturalization, you will be asked about your tax return status.
