  • Returning to US on a green card after a long absence.

My name is Ola and I am writing to you on behalf of my younger sister Iza with an inquiry about her options for returning to United States. Both my sister and I received Green Cards in February of 2009 with our Mother and Father thru my maternal Grandmother who is a US Citizen. At the time I was 18 years old and made the decision to move to US and am now a US Citizen and a College Graduate myself. My Sister was 13 years old at the time and my parents made the decision to travel back to our home country of Poland so she could finish her current education there. Not long after my sister was diagnosed with a serious chronic disease leading my parents to decide to stay in Poland.

She is now 21 years old and it has been over 6 years since she last visited US, but as she is now capable of making her own decisions, and her disease is more manageable, I would like her to come and live with me why she attends Art School in Chicago. To do so she attempted to submit DS-117 (for getting the SB-1?) at the Polish embassy in Warsaw per advice of the staff at the Krakow embassy. She was informed that due to her disease not being considered serious enough to prevent her from boarding a plane, and the long period of time her petition was not going to be accepted.

My inquiry is thus about the most likely options available to us. Our primary goal is for her to be able to attend Art School in Chicago soon, and while it would be ideal if she could immigrate to the US, we would be grateful for any opportunity to make it possible for her to attend a US university. Should she formally 'abandon' her Green Card as it is unusable and then attempt to obtain a Student Visa? Re-apply for a Green Card thru her connection to me and our Grandmother? Are there other options available?

Thank you very much for any help and directions you can offer us.
