Hello There,
I am in a dilemma right now and would like to seek the advice/expertise of the fellow members or experienced folks here. I am currently on H1B which is expiring this oct 2016 (first 3 years) and I need to ask my employer to renew it. I'll have 3 more years of the 6 year quota at the time of renewing. My 1-140 is approved.
However, I am in the midst of interviewing for different role at the same company and seeking an internal transfer if everything comes out well. So, I am not sure if I have to first file for an extension before accepting the new role and change roles after my extension comes through and file a new H1b for the new role OR accept the role first and then file for a new H1B application which will automatically mean an extension.
At the crux of the situation, I dont know if changing jobs within the same company needs a new H1B application.. Location is going to be same, only change is a slight job description and title. I cannot talk to our corp lawyer at this point as I am still pursuing the internal transfer and I dont know for 100% that I will get the job. Any advice is appreciated. Thanks !
