  • Attending H4 after 7 months of my husbands departure to USA

    Hi My husband got his visa in Jan 2008 and he left to USA in May 2008. He came to know that there is actually no job waiting for him in USA and consultancy is not paying him either. when he's decided to come back and join his last company in india he luckily got job with another company and they transferred his H1 to their company. we got married in Feb 2008. we had planned to go for my stamping once he settled with his job in USA. because of this consultancy problem it got delayed untill now.
    1) My husband currently with new employer but his passport Visa shows old employer information. Is it ok if i carry copies of his I-797 of the new employer. what if VO asks for payslips of the old employer ?
    does he needs to file a case against them for not paying him ?
    2) He used to work in Mumbai, but i am from staying with my parents in AP. is i better to go Mumbai only or i can go chennai embassy?
    3) Is Bank statements of my husband compulsory?

    Any other suggestions, precautions i should take ???

    How did your husband's H1b transfer get approved if he was out of status for such a long period?

    You will have issues if the VO asks for a W2/wage statement of your husband or YTD pay is far less.

      He reported to company A in May 1st week and filed his petition with company B in last week of June got approval by last week of Aug. company B running his pay stubs from August. do my husbad need to file a petition against employer A for not paying him and for that first 3 months period?
