  • Legal issue with Marital Status change. Please help

I got married through a registered marriage in 2006. I got my passport in 2007. My husband had his passport from 2005. After the marriage, he did not change his status to married and came to the US in 2006 on F1. I also did not mention status as married when i applied for my passport. I came to the US on F1. Could I send our passports to the embassy in US with the marriage certificate to get our marital statuses updated to married. Will I get into trouble for not mentioning married in my passport application when i was already married ??

Any suggestions will be highly appreciated.

Getting it updated on PP is not an issue. However, both of you have clearly mis-represented the facts on a visa application which is perjury. Also, an observant IO during green card filing can easily question how one could obtain a F1 visa when the marriage certificate has an older date on it.

You have done a costly mistake and it could come back to bite you later on.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

Did both of you not mention your marital status as married on DS 156 when you applied for Visa? If so, that was wrong. For PP it should be ok.
This is my opinion and not legal advice.

Hey Guys, Thanks for the replies !!! We have not mentioned the marital status anywhere and I guess that was a big mistake.
