  • Please urgent help!! H4 and f1 bot

    I have just returned to the american embassy and I was given my F1 visa. I was living in the US under an h4 dependant visa. But I noticed that they did not remove my H4 visa...Is this ok? Can you have both of these visas at the same time?? I really dont want to have problems during immigration

    Please give me your thoughts!

    Hello,

    2 visas should not be there.Its a rare error.Once they give f-visa, they need to take out h-4 page out of passport.So, call to the embassy and inform your situation so that they can take care of it.It will be tough to return back with both the pages in the passport.So make sure, embassy identifies this problems and resolve it before your trip.

    Please post what documents are needed and how was the transition from h4 to f-1.My conversion to f-1 from h4 got rejected.Please post your experience in regard to it.Embassy felt like i could not convince them coming back to India after my M.S.What questions did they ask you and how did you convince them inregard to this??

      I have a B-1 and F-1 visas on my passport and it never was an issue during the past 2 years. I have traveled abroad thrice. So, I think it will be OK. But I am not sure if you can have a dependent and a F1 though. I guess it's the same as having an F1 and a B1.

          You area allowed to have F and H visas at the same time. Visas are never removed from the passport but stamped CWOP if they need to be cancelled by the consulate.

            H4 to F1

            Hi ,

            I am currently on H4 and completed 1st Sem on H4 visa status. School had issued the I-20 during my admission in Sep 2009. I applied for change of status from h4 to F1 in Dec 2009 and submitted my original I-20, I-94 along with I-539[change of status] and passport and visa copies. I also submitted my husband's bank account details to provide evidence for financial support.

            I got a mail on 26-Jan-2010 from USCIS asking me to furnish few other documents like
            a. Submit a new properly signed original SEVIS I-20 with the same SEVIS number as prev I-20 as the prev I-20 program start date has lapsed.
            b. Submit evidence that the I-901 SEVIS was paid.
            c. Copy of I-94 [front and back] . [Note: I have already submitted the original initially].
            d. Submit form I-134, affidavit of Support.

            In the meanwhile, before I submitted I-539 in Dec-2009, My husband filed for I-140 for GC process and got it approved. He has included my name too. Also his H1-B and my H4 is getting expired this 1-March-2010. His employer has applied for the extension and we have not received the receipt yet.


            So Following are my questions:
            1. How do I get the I-20 with same SEVIS number but different start date for MS program? I inquired in the college. Should the start date be the start of next semester i.e Summer [ as I have completed Fall'09 and started with Spring 2010. So should the start date be Summer 2010???].

            2. Will there be a problem for processing my F1 as my H4 is about get expired??? though we have applied for extension of H4, we have not received the receipt yet.

            3. How does tha approved I-140 affect my F1 processing??? I heard that since my husband included my name in I-140, USCIS might reject my F1 COS.

            Please reply me at the earliest.

              Same issue ,

              i got RFE:The program state date on I-20 lapsed. Submit a new properly complete orginal SEVIS I-20 with the same SEVIS number from the present school reflecting a program start date for the next
              valid school term. Do not submit different SEVIS ID number.
