H4 VIsa stamping for my son

Hi,

I am looking for some information on the H4 visa restamping for my son.Following is the scenario.

1.Travelling to india.
2. Wife has H1 and my son is on her Peition as H4.
3. only my son and me will travel and wife will not be able to.
4. I need to get stamping for me and my son.

Question is

is restamping possible fo rmy son in india when my wife is not there with us? If yes then what is the processs.

It is possible. The procedure is no different than when she was also applying for her Visa.

Hi OP,

Once you are out of US....you don;t hold any status like H1/H4.

So if you want - you can get H4 re-stamping for your son on your H1 also ( I am assuming you are also holding a valid H1 petition) and it's not necessary that H4 should be again dependent on your wife;s H1.

If you are also on H4 - then you need to carry all the necessary documents required for H4 (please see immihelp list) for you/son
