  • F1-Cancelled without prejudice..

    Hello immihelp
I am a graduate student. I have gone to US for MS in Fall 2009(My F1 visa validity is Aug 2008-Jul 2013). I completed 1 year of study and I came to India in Summer 2010. Since then I have not been able to get back to the university to resume my studies. The same university advised me to apply once again to the same old university to resume studies from thereon. fearing the university may not grant me the admission, I applied to another university in Texas. I have been issued a new I-20 of th eTexas university. I went to the interview with the Texas univ I-20 since I could not get my older univ's I-20 on time. The V.O put a stamp on my existing visa " Cancelled without prejudice". I now have my older univ's I-20 in advance to resume studies for the Spring 2012 semester. I am really worried whether my Visa will be issued or not. Please help me out if any of you came across such experiences or have any idea about what's going to happen next. Is it possible to resume studies after a gap of 1.5 years. Will the V.O issue me the visa or not?

Was the Visa for Texas univ denied?
Have you again applied for Visa with older univ I-20?

I could not attend the older univ for the Fall 2010 semester. As the I-20 was outdated(stayed in India for more than 5 months), I asked them to send a new I-20. For that the univ advised me to reapply. I did so and they responded after 6 months only to let me know that I have been granted the admission two weeks just before the Fall 2011 semester is about to start. Meanwhile, as they asked me to reapply for resuming studies, I feared they may even deny my admission, so I applied as a Transfer student to Texas univ for the Fall 2011 semester. As the Fall semester time has been approaching and the admission status at the older univ still unknown at the time, I went to the Consulate with Texas univ. In the first attempt, they cancelled my already existing visa. In the second attempt(with the same texas univ) my visa application got rejected.

The older univ has sent me the new I-20 that I have to attend in the Spring 2012 semester. which univ do you recommend me to go and whether would I be given visa to resume my studies and graduate from the univ? I have been waiting all this time only to resume studies.
What are my chances of getting the visa.

If you want to study at old university, you should apply with their I-20.
Unfortunately, your past 2 rejections (you applied 2 times with Texas I-20 and got rejected both times right?), will negatively impact your subsequent application.
You have to prepare convincing and true answers to questions like 'why this university, why this program, what will you do after the program' etc. There may also be questions regarding how you plan to fund this education. Having property, job, business helps.
This is my opinion and not legal advice.
