H-1B Extension - HELP Please

I work for a government agency and my h-1b is nearing the 3 year limit. I wanted to extend my h-1b for another 3 years and my employer applied for online LCA, but here is my problem.

1. I started with $40,000/yr 3 years back and at that time the prevailing wages for my job was $36,000/yr
2. My current salary is $42,000/yr and the prevailing wage is $45,000/yr
3. Since it is a government job, my boss does not have any authority to increase my salary or change the job title
4. My employer submitted a letter to DOELTA and they forwarded my query to the Chicago labor office.

What are my options now and how can I get over this obstacle?
My H-1B is expiring soon and any help is greatly appreciated.

Hi,
Getting a letter written by your employer explaining to the Consulate the reason for your LCA non-compliance alongwith the proofs of steps taken to rectify this non-compliance should help.
