    Default Widow Mother's visa got rejected

    Hi everyone,

    My mother had interview on 24th may 2012 to mumbai consulate for B2 visa in gujarati.She applied for 5 months tourist visa I am living in US since 1 year and I am on H1B visa with very good job. I sent her all the document and taught her about interview, I guess she did good but still her visa got rejected under 214(b). She is been working as teacher since last 28 years in india and she is widow, I am the only one child she has.
    Here are the qustion VO asked her:
    Q. Who is sposoring you?
    A. My son
    Q. What is your son doing?
    A. He is software developer in XXX company
    Q. What is his status?
    A. He is on H1B
    Q. When did he go?
    A. July 2011 (Actually went in May 2011 and started job, I had to visit back india just in
    20 days in June 2011 due to one family emergency, then I came back to USA agian in july 2011) Q. What is your husband doing?
    A. He passed away (Isn't it stupid quation because she is window that was written in DS160)
    Q. How many childrens you have?
    A. I only have one child.
    VO said sorry your visa application is rejected then my mom said that I just want to go for tourisam purpose only. he said sorry then he asked my H1 papers, my mom give him all the papers. He just looked and said sorry your visa application is rejected. Its so sad how can she be intended immigrant while I am on non immigration status? and while she has job and
    savings in india.
    When should she reapply for her visa?
    Should I use some diffrent approch next time?

    It is not a fair system but that is how they decide.
    They think a widow would like to live with her only son , so she won't come back.

    Even on reapplication you can't change
    the main reasons for denial; widow and only child in US.

    Frankly, it will be difficult for her.

    I know reason is not going to change next time.
    If this is how they decide to give visa then why don't they make rule that perents of only one
    Child who lives in US can not apply for visitor visa. Atleast that could save our money and time.
    And how can she settle here permently while she has job in India and I am in H1B a non immigration
    Visa? Last time she asked for 5 months visa, will it make difference if next time she ask for lesser time like 1 month?
    I know she can reapply anytime but how much time gap for reapplication would be good.
    If my company files for my green card then does it make any difference on her
    Visa application ?

    You can try to apply for visa again - any time really.

    May be this time - you need to show stronger ties with the homeland. Some of the things that have worked in the past for people are:

    1. A letter from employer that verifies the employment and sections the vacation.
    2. Bank account statements
    3. Real estate documents and bank account statements
    4. Completely dependent dependents

    She had all the document that you mentioned in 1 to 3 last time but VO didnt even looked at it.
    What is Completely dependent dependents means?
    I have relatives in UK. what if she travel to other country like UK? and come back on time. Does it improve her case ot show tie to india? or if she apply for USA visa from UK does it make any diffrence?

    As folks have said you being an only child and being a widow worked against your mother. What may have also caused the rejection is IF your mother (mis)communicated in the interview that she wanted to spend 5 months in the US. That makes no sense since your mother is a teacher and only gets about 2-3 months vacation (unless she's a professor).

    Completely dependent dependent means (if I understand the person correctly) someone who fully relies on another to survive eg a child, old parents or an invalid (someone who is physically/mentally handicapped). Zakasbanda mentioned this as it may be seen as a reason why your mother has no intention of staying in the US beyond vacation time.

    Your travel history with any other country has no bearing on the outcome of a tourist visa for the US. Unless she's a citizen of the UK applying there will not make any difference.

    Thank you all,

    She is not completly dependent on me, and I think her interview went well.

    May be next time she should apply for a month or two.
