My company placed advertisements as required by Dept of labor based on guidelines from our immigration attorney (one of the leading attorneys). Ads were placed in:
1. State Job Bank - positions: 1
2. News paper (print and online) - positions: multiple openings
3. Internal company (referral, online job posting) - positions: multiple openings
After 45 days of placing ads as per above, immigration attorney stated that we need to place an ad again in 'State Job Bank' (# 1 above) as the number of positions open is not consistent across # 1 through # 3. Immigration attorney has told to change the number of openings to 3 (cannot put 'multiple openings' as it defaults to 1 in State Job Bank website).
As I am running out of time (this is my 6th H1B year), I want to know if we really need to place an ad for 30 more days just because the number of positions displayed was 1 vs. 3 in the State Job Bank? I canít see how that would possibly be material or cause any recruitment confusion for an applicant. The position was visible and open to all applicants for the full required time period. Isnít that sufficient to proceed with PERM application?
