    Default L1 Extension

    Hi,

    I have filed my L1 extension on December, 2011. Till date, in USCIS website it is in "Initial Review" status. Does anyone know, how long the extension process is taking to be completed nowadays? My I-94 has also expired along with the visa in January, 2012. How long can I stay in US with the file number?

    You should have upgraded to premium long ago. It is never advisable to stay beyond ones I-94 expiry, irrespective of extension pending or not because if for any reason your extension is rejected, all the time spent by you after I-94 expiry will be considered illegal stay i.e. from January 2012 onwards, in your case. Illegal time spent in US can result in long term bans from entering US in future. Dont risk it, upgrade your case to premium and get a decision within 15 Days. This is my opinion, do consult experts too.

    Since it is past 90 days, ask you employer/attorney to take an infopass appointment with USCIS to discuss your case.
