Valid H1 period when convert H4 to H1

Hi,

I entered US on H4 visa in Feb 2008. I applied for H1 visa and got it approved in May 2008. But as i begun work from Oct 1st 2008, how the 6 year validity be calculated ? From Date of approval of H1-B or 01-Oct -2008 ? Is there a possibility to reclaim the period between May 2008 to Sept 31-2008 ?

Only the time spend in U.S in H1B (+ L1) status should be counted towards the 6 year period. You shuld not ocunt the time you were on H4.
