    Default Waiver probability?

    Does anyone have any experience with the Waiver process from Mexico. My fiance was denied a Visa due to his previous illegal residence in the states, but is allowed to file for a waiver. His appointment is in 2-weeks and I'm a nervous wreck. I've sent him all of the necessary information on hardships, but I would just like to know if anyone has received a waiver.

    If he got red flagged then i can tell you it will be denied because of recent illegal entry in the USA is not kindly looked upon with CBP.

    The Visa Officer that denied him said he didn't have a big problem and would get a waiver if he applied. Anyone received one and under what circumstances?

    I know several in the process, all with attorneys specializing in waivers. One tried to do it without help and was denied. Got it reopened and has paralegals in Mexico working on it now. My gardener is here illegally and his attorney says he does not have a strong enough hardship case because he and his US wife have no children yet. He has a business which brings in $200k gross a year. He pays medical bills out of his pocket--- like $40,000 for his wife's surgery this year. He pays income tax. Yet he is afraid to file the waiver and return to Mexico under the newish waiver policy. So it has to be a solid, well prepared legal brief in my opinion to enhance the chances of success. I'm not a lawyer or have ever used one for immigration--all the way from fiancé to citizenship, rather quickly with no hiccups or delays over anything. But I would certainly consider it with a case like yours.

    Default Today's the day!!

    The appointment began at 12:00 pm EST. No, we haven't used any lawyers so far, but I'm confident in the hardship he has to present. We do have a small child together, all of the children have ongoing medical issues they are undergoing treatment for and I provided him with medical records for all of the children. I sent letters from my employer, mortgage lender, information on the current market value of the home. Letters of recommendation from other family members regarding the hardship that his absence has caused to the family as they have had to pick up his slack. Things like that; I tried to follow their guidelines as closely as possible regarding what is considered a hardship in all categories. Hopefully it's enough. Wish us luck. I will post the results as we get them.
