    Default I am a Green Card holder but I have a US Citizen Baby..

    Hi my name is Realyn, I am a Green Card holder and I have a baby which is born last june 4th so,she is a US citizen.. I came here in america with my family.. So, I just wanna ask if how can I get my baby's father (my boyfriend) because he is in the Philippines.. how can I get him so we can live here in america together with our baby? what petition can I do?

    K1 if you guys are not married, K3 if you guys are.

    k3 i think.. and how long could it take??

    I've heard K3 generally takes longer than K1 process. I'm not really sure exactly how long but K1 takes anywhere between 6-8months.

    Umm correction K1 is 5 month process or sooner than that...

    You are not eligible to petition for a fiancé because you are not a US citizen. He could not get a K1 or K3 at all. It doesn't matter if his child is a US citizen. Children under 18 can not petition for anybody.

    As a greencard holder, you can petition for your husband and the wait before he would be eligible to apply for a visa (IR1 or CR1) as of this month, is around 2.5 years. It changes every month. So you would file a petition, get it approved, then wait in line for a visa to become available. There are number restrictions. His category would fall into second preference. If you were a US citizen, then no number limits on visas and no wait for years for your date to come available.

    A K3 visa is pretty much dead. Changes to the process basically mean they don't happen anymore, even though they have not been taken off the books. Spouses will get the IR1 or CR1 visa depending on how long you have been married, but not a K3 anymore.

    The 5 months you are quoting is probably only the I-129F petition approval by USCIS . Then there's the time passing through the National Visa Center where the Dept of State takes over, before getting to the foreign embassy. Once there, the fiancé applies for the K1 visa. Depending on the embassy, that could be several more months, more documentation, and more application fees before the visa is in hand.
