    Default Unused H1-B Period

    Hi,

    I processed by H1-B in year 2008, I could not travel in year 2008 and 2009 and finally entered USA in March 2010. H1-B was due for renewal in Oct 2011, I renewed by H1-B in year 2011 and I managed to get the extension till July 2014.

    My questions is; “Can I use the unused H1-B period (i.e. 2008/2009) after July 2014 and how?” Appreciate your responses.

    Only the time spend in U.S in H1B + L1 status counts towards the 6 year period. The time spend outside U.S can be recaptured. This can be done using the copies of the entry/exit stamps in the passport, copies of the I-94 cards and flight tickets. Your company attorney will know how to do this. Talk to them.
