  • F2 visa rejected

    Hi all,

I am on my OPT extension and working, my OPT will end next year march and was not able to make H1B application with in quota. I have applied F2 visa for my wife which was denied under 214(b) twice from US embassy.

She got admitted into a decent university for MS program, but I am not sure, if we can get F1 visa approved because of previous F2 rejections. Please suggest which one among F1 or F2 would be a better option and with higher chances of approval.

In case, if we want to reapply for F2 visa, with my OPT ending by 2013 March, which is before even uscis accepts H1B applications (which would mean I have to leave country by March) and she is working (there employer agreed to approve one month vacation). With enough financial resources would all these scenarios will be sufficient to clear 214(b) requirements.

    Please share your thoughts.

    Thanks in advance.

With previous denials either F1 or F2 is going to be difficult. I would try for F1 if at all.
This is my opinion and not legal advice.
