Thread: 10 year bar

  1. #1

    Default 10 year bar

Does one have to file a form after the completion of the bar period to enter into the United States? My family based immigration has come through but due to a 10-year bar owing to my overstay I am not allowed to immigrate until 2014 when the bar expires. Would I have to file another form (waiver) like I-192 or I-212 or I-601 to enter U.S.A.?

I have read somewhere that a documentary proof will have to be shown to the border post explaining the expiry period of the bar and no form is required. However, any one who has experienced a similar circumstance may please guide me. Thank you.

Once your priority date is current, you should be contacted by the US consulate. Also I would suggest to ask your sponsor to get some information from here. I have a friend who is exactly in the same situation like yours. He has already started his paperwork via the local US consulate in his country.
    Good Luck

I am not sure if this reply is in response to my question. However, thank you but my question is whether one needs to go through a procedure to enter into the United States after the expiry of the bar period. (3 years or 10 years).
