    Default Medicare and Social Security Tax

    Hi all,
    Friend of mine is working in h1 for few yrs and his employer just figured out that they did not detect medicare and social security tax from his payroll. He has been asked to pay the tax now for all the years.

    1. What is the legal obligation for him to pay all those yrs.?
    2. Since it is employer's mistake, does he have the rights to ask employer pay his portion?
    3. Does he need to notify any one like IRS or Social security agency or anyone?

    Employee needs to pay his share of social security and medicare tax no matter what. Employers are authorized to deduct that (or ask for it) and remit it to the government.

    Just because it is employer's mistake, it does not mean your friend is not obligated to pay that.
