F-1 stamping while husband is on H-1B status with I140 filed.
Hi,
I will appreciate any opinions you may have on our particular case.
I am on H-1B status (COS in US) and my wife is pursuing school on F-1 status (COS in US).
Previously I was on F-1 OPT and she was on F-2. We got our approval notices recently.
My company would be filing an I140 for me in October under the EB-1 OR category.
We are planning to travel to India in December and get our visas stamped.
I am aware that my H1-B should not be a real issue but I am worried about my wife's F-1 stamping.
Would she have trouble given that I am on H-1B (dual intent) and filed my I140?
I am the one sponsoring her studies as stated on her I-20.
