  • OPT extension for MBA Students

    Hello everyone,

I have couple of questions, can anybody help me in that.

I have done my masters in MBA and graduated in March 2012. My opt period is from April 2012 to April 2013.

Que 1: Can I extend my OPT?
Que 2: If not I am wondering do MBA's get H1-B Cap gap?
Que 3: I was working when my opt got started and used almost half of the opt. Now I am not working since last 4 months. I wanted to know wether my opt is still active or not.

    Please clarify my doubts..

-- No. MBA is not STEM.
Que 2: If not I am wondering do MBA's get H1-B Cap gap?
-- Yes they do get it
Que 3: I was working when my opt got started and used almost half of the opt. Now I am not working since last 4 months. I wanted to know wether my opt is still active or not.
-- That is a problem. You are only allowed 90 days of unemployment. You must report your employment status to your school. In order to change status to H1, you will need to provide proof that you are maintaining F1 status and unemployment for more than 90 days is violation of F1 status. You need to leave the US or change to another status immediately.

    See above.
This is my opinion and not legal advice.
