  • H4 to H1B or fresh H1B, which is easier?

    Hi,

    Presently my husband is in USA on H1B and I am working in India. I am looking for an employer/consultant who could file for a H1B visa for me. I hold a B.E. degree and 6+ yrs of experience in the IT industry , have also worked in the US for 2.5 yrs on L1B visa in the past when I was unmarried.. What I'm trying to convey is that as such I am eligible for H1B.

    Would it be easier for an employer to file for H4 to H1B (COS) for me if I travel to US on H4 visa before April 1, 2014 OR would filing H1B while I am in India would be a better option?

    P.S: I am looking for a list of employers / consultants who can help me with H1B visa processing, i'll appreciate it, if anyone can help!

    H4 to H1B or fresh H1B, which is easier?

    1. If you apply as a COS, You should work from the effective date once it is approved else you would become out of status.

    2. If it is a consular process and If you are here in the US on h4 when it is approved, You can apply COS from H4 to H1 and then can start working.

    This is my opinion.
