  • Cap exempt for a H1B petition which is revoked after 221g

    Hi
I had an approved H1B Petition from Employer - A, which was valid from OCT-2008 to SEP-2011. But did not went for the stamping as Employer-A lost the client, and they were unable to provide me required documentation.

And again applied through Employer-B, and had an approved H1B petition in 2010 valid for OCT 2010-JUN 13
But in the embassy when I went for stamping,I got 221g asking for Employer details-full details(wage report/client info etc)
But the embassy people were not satisfied with the additional documentation provided by the Employer-B and updated the case status as below.
On May 8, 2013, the previous decision made on your case was revoked and we mailed you a notice explaining the decision.

Now Employer-C has a position for me but we missed the 2015 cap.
Can I use any of the above H1B petition (approved & revoked) to get exempt from cap.I have the receipt no.s and copies of the same.

    Please advise.This is urgent.
    Regards

    Yes bro...

I think you can reuse the approved petition to get cap exemption this time.
