  • Canadian permanent residents &HRR

    I am an Iranian citizen, and I have my Canadian Permanent Residency.

    I have a postdoctoral grant from Quebec Government (Canada) to carry out a
    comparative research between Canada and US. So I have a double registration
    at McGill University and UCLA. However, UCLA has registered me only as a
    Visiting Scholar.

    I have an appointment at Montreal US consulate next Wednesday.

    My questions are:

    1) Am I subject of two years of residency? (Someone told me as I am not a
    Canadian citizen and I don't have a US grant, I am not subject of these two
    years. Is it true?)

    2) If I am, where should I go? To Iran? Or I can stay in Canada?

    Thank you in advance for your help.

    An exchange visitor is subject to the two-year home-country physical presence requirement if the following conditions exist:

    1.Government funded exchange program - The program in which the exchange visitor was participating was financed in whole or in part directly or indirectly by the U.S. government or the government of the exchange visitor's nationality or last residence;
    2.Graduate medical education or training - The exchange visitor entered the United States to receive graduate medical education or training;
    3.Specialized knowledge or skill: Skills List - The exchange visitor is a national or permanent resident of a country which has deemed the field of specialized knowledge or skill necessary to the development of the country, as shown on the Exchange Visitor Skills List. Review the Exchange Visitor Skills List 2009.

    ----------------------------------

    2 and 3 do not apply to you . But 1 does as your country of last PR( canada) is financing the program.

    And you will return to canada as that is your country of last legal permanent residence.

    Also be aware that there are waivers available for the 2 year requirement.
