H1B expiring and H1B Extn petition received RFE

My Visa is expiring in Mid-Aug and My Visa Extn(Premium) petition has just received RFE. My Employer is working with Attorney to understand their requirements and will reply to USCIS.
My Question is: Can I legally stay in USA when my Current visa is expired(Mid Aug) and Visa Extn petition is pending for Approval(RFE is replied by employer) or Still in Suspended State(RFE is not yet replied by employer)?
