    Hi all,

    Just a quick question to see if anyone has ever been in this case or has advice.

    I was doing business in the States for several months under a B1 visa and asked for an extension of stay. In the meantime, I got sponsored by another company for H1B. Hence, my visa extension was denied on the grounds that I had not established that my stay was temporary and that I had an intention to depart from the US within a definite timeframe (since I had an H1B petition, they could not keep my non-immigrant status). Now, I could not appeal this decision.

    I can wait for October for my new visa to kick in, but my current employer in France is not very happy that I got kicked out (I went back to my home country within 15 days).

    Is there any way I can apply for an ESTA to continue the business I'm conducting for my current employer until September, take a return ticket to show I am willing to come back or will I immediately be dismissed for the same reason that my B1 visa was denied? If not, can I go on vacation in the States (since I'll be out of a job)?

    you said you were in US on a B1. Can you give the following dates;

    1.the expiry date of your B1/B2 visa in your passport
    2.the stamped last date of your authorized B1 stay when you were in US .
    3.the date you received your denial of extension
    4.the date you left US.

      1. Expiry date was March 29, 2014
      2. Stamped date was April 6, 2014
      3. Denial received July 8, 2014
      4. Return date was July 22, 2014
