  • I140 withdrawn/revoked and ending 6-year on H1-B ..options?

    Hello,

My 6 years on H1-B are ending in a couple weeks and, unfortunately, my company had a layoff in which I got impacted. My company informed me that they have withdrawn/revoked my Residency application (I-140).

Any idea what options do I have ?

    Thanks.

I'm not expert, Up to my knowledge, you dont have any option other than leaving US for now. You need to be out for 1 year to complete cooling period and find a new sponsor and come back to US on new H1b. One good news is that if your earlier I-140 is approved (that is currently withdrawn), you can still use its Priority Date when your new employer files GC for you. In that way, your so far journey towards GC is not impacted other than the hassle of employer change and cooling period.

    Hope it helps.
