My wife, intended to register this fall, but her change of status from F-2 to F-1 got delayed, so she could not register. The petition got approved on Sep 15, and in the meantime, the college deferred her attendance in SEVIS until next spring (Jan 14, 2015). I have not yet received the notice of approval, and it may have a "valid from" date to be Sep 15, 2014 or Jan 14, 2015. Her original status F-2 was dependent on my F-1, but my status will change to H-1B at the start of October, and I did not apply for her change of status to H-4 because she applied for F-1 in summer. Now, my concern is about the legality of her stay in the USA until the classes start on Jan 14, 2015. Do I need to apply for her H-4 and then re-apply for a change of status before next spring? Your response is much appreciated.
