Default Is L2 valid after L1 returns back to India

    Hi,
I'm on a L1-A visa and my wife is here on a L2 visa. She now has a EAD and is working here with a company locally.
I have to go back to India in April but my wife needs to continue to work here till July because she is crtical to her project.

    Question:
    1. Is her L2 visa status valid even after the L1 (me) is no longer in the country?
    2. If the answer to above question yes then is her EAD also valid?

    Would appreciate a reply

    Regards
    Rahul

L2 is a dependant visa based on status of L1. If L1 expires then L2 also automatically expires. If L1 is valid, so will be L2; it does not matter whether L1 is outside US for short period.

Default Is L2 valid after L1 returns back to India

    Thanks Nishant,
I also checked up with USCIS . They confirmed that the presence/or absence of the L1 in the country does not affect L2. L2 can stay till status of L1 is valid.
My next question was what defines valid status of L1. They could not give a conclusive answer but finally summarized that if I-94 of L2 is valid L2 can stay.

    regards
    Rahul
