H1-B Transfer - Recipt not received

Hello,

I had H1-B visa with company A and then got a job with company B in October. Company B applied to get the visa transer in October. They have not yet recived the recipt number. When I called INS they said that they have returned my petition as it is not in Quote. My lawyer is trying to explain them that since my case is for transfer I will not come under Quota. In the mean time can I start working for company B?

Please advice.

Hi,
You can actually start working for the second employer, if they have just filed for your H1B transfer. You will fall under AC 21 aka Portability Rule
