  • Permanent Resident - Registered to Vote

    Hi Guys,

    I was registered to vote by mistake at DMV/RMV office while issuing a driver's license.
    I have never voted in any sort of elections.I have never claimed that i am a US citizen.
    In the DMV/RMV form as well i have checked that i am not a US citizen.

    As soon as i found out that i was not supposed to register to vote, i went to City Clerk's office and cancelled my registration and also got a certified letter from them telling my registration was a mistake and has been cancelled.
    I also got the copy of the form that i filled while getting my driver's license.

    Now, while preparing my N-400, i am little worried.

    Has anyone faced this situation before. I would like to hear your experience.
    Any Suggestions and Feedback is Welcome.

    Inappropriate voter registration is taken very seriously by USCIS when you submit a Naturalization application (N-400). Admission of registration and/or voting is grounds for denial and later adverse adjudication by USCIS. Your particular experience of mistakenly registering is not uncommon and the evidence you acquired will probably allay any problems with USCIS when you apply for Naturalization.

    FWIW, voting in Federal elections and "most" local elections by non-citizens is illegal, though some local elections (State and local) do allow for Permanent Residents to register and vote (varies by state and locality)

      Worst case Scenario; if they deny my application, and after multiple Appeal, if they don't Approve my case.
      Can i keep my Green Card? Or, will they take away my permanent residence status?

        There is no reason to expect a denial, since you have proof that the inadvertent registration was rectified and confirmed.

        A denial of N-400 for discovered immigration fraud, however, can result in threatened loss of Permanent Resident status and a deportation order. There is a hearing process availabel in such circumstances that will counter any deportation and eventually get it reversed (with evidence of no intent to commit fraud).

              Hey,

              I too made the error of registering to vote but never voted.

              I immediately contacted my local voter registration office and had my name removed and I asked for proof and within one week they removed my name and mailed me proof. I mailed the original proof with my N400 application along with an explanation that it was an accident and that I have never voted.

              My N400 was accepting and currently I am scheduled to take fingerprints on 04/14/2015. They have not yet mentioned anything about the voter registration but if they do I will keep you updated

                What documents did you get from local voter registration office? is it just a printout saying that you are unenrolled or is it a letter from them in a certified letter? Make sure you have a certified letter in their Letter Pad.
                I also got a copy of the form, in which the error was initiated.

                I am yet to recieve acceptance notification.

                  The clerk sent me a certified letter stating that my name had been removed and per their records I have never voted in any elections. She noted in the letter that if USCIS needed the election records she would overnite it. I sent the original letter along with the envelope it came in directly to USCIS and kept a copy for myself.

                  Today I went in to take my fingerprints and from what I am told if you have a clean criminal record then it should only take about 1 to 2 weeks.

                  I will let you know if I receive a letter asking for more proof.

                  Also if you sent the form for electronic notification (G-1145) then don't expect it to ever update lol. mine is still stuck on the initial approval and it seems like they rarely update it.

                    I received acceptance confirmation with a receipt number.
                    I think G-1145 is just for the first time when they accept the form. After that there will be no electronic notification(text/email) sent to us during further process. We can check our case status online for later processes.

                      So I just received an email and text saying that I was placed In Line for an interview so I guess I passed my background? That was way too fast o.O but I am not complaining

                            It's great that you have done the right thing in clearing your name off that list but that doesn't mean you are 'out of the woods' because if you are asked that question, have you registered to vote, you must speak the truth to prevent real repercussion. Good luck!!

                              Yes, definitely. In the Form i have checked that i have registered to vote and also written a clear detailed explanation of the scenario, that resulted in the registration.
                              Also,i have included all the evidences that support my explanation.
