    Default PLEASE give me advice on the best course of action and clarify...

    I need a little clarification and I really hope somebody can help. My Girlfriend is a US citizen and I am from Scotland. We have dated through college and are now fed up of being forced apart by laws. I have been researching as best I can all my different options...

    1.Her filing an I 129f, once cleared I wait the 3-6 months for a Fiance visa to be processed by London

    2.We get married in the UK.. she files an I 130F and I still wait forever for a K3 to be processed in London.

    I just want so bad to be done with this and to be living with her. I have a job offer waiting for me in the US as well which I would desperately like to take - we are investigating this 3rd option and this is where I need help.

    If I enter the US as a visitor under Nonnimigrant visa to "meet up with my friends from college" and we subsequently get married...I understand that then an I 130 and an I 475 (change of status) can be filed at the same time. This seems so much easier than the other two but I'm guessing there is a catch. How long can I stay in the country for when those are being processed? If the processing time takes more than the 90 days allowed by the visa waiver, do I just have to go home?

    Thanks so much if you have any opinions on this or if you have any advice on Lawyers that can speed up the I 130 process. I really appreciate it and feel for all of you in a situation like mine.

    I really am not sure about the I 130....i mean if you get married and then go home....chances are they will not even let you back in the country when you try to re-enter the U.S.
    The reason i say this is because my fiance is from canada and i am a US citizen....he was here with me and we were given some wrong advice from a lawyer...and this was before we knew about any of these forms to file....we went up to canada together to visit his parents for the weekend...on our way back in he mentioned that we had plans to marry....and they would not even let him into the country....we were told to file the I129F
    This is just my opinion....but doing the I129F is a way safer way to go....you don't want to be caught up in a lie somehow that you can into the US having an intent to marry....
    i know its horrible being away from her....but wouldn't you rather go through that for a while then messing up and being banned for several years?
    Also, the fiance visa is pretty simple...it is something that you can do without a lawyer....they cannot speed up the process any faster....they have no power over how quick your application is processed....they do however make sure that everything is filled out correctly so nothing is sent back to you to be changed....delaying the process
    But...maybe someone on here knows a little more about the I 130 process so they could help you a little more with that
