My company is going to apply for my H1 b but given the odds of 1:3, I have approached an attorney to process EB2-NIW green card and that may get me an approved i-140. I can stay in USA even if my H1b does not get picked up to October 31 2016 (opt expiration date). So my question is that can I continue staying in USA even if my h1b does not get picked but I get an approved i140? Thank you for your responses and I appreciate the work this community does!
