Hi,
I am currently on my 6th year of H1b. My current visa expiry is 07-Nov-2016. My perm was filed on 21-Dec-2015, that is NOT 365 days before the current H1B expiry.
Question: If I go out of USA for 2 months, will the recapture happen right away & my new expiry be 07-Jan-2017? Also, does that mean my Perm filing was done 365 before my visa expiry?
In a nutshell, visa expiry dates can change depending on recapture right. How will that impact the 365 day rule for Perm filing?
Any input on this is greatly appreciated.
